Empática offers a platform for customers to develop and manage mobile Apps for communication to employees, customers, shareholders, neighbors and other stakeholders. This App has been developed with Empática. Empática is a platform owned by Atrevia Comunicación S.L., with CIF B67253732. By using this App you agree to be bound by the following terms and conditions.
Empática reserves the right to update and modify the Terms of Service without previous notice. Any new features that change the current Service, including the release of new tools and resources, will be subject to the Terms of Service. Your continued use of the Service after such changes will constitute your consent to such changes. You may review the most current version of the Terms of Service at any time here.
Violation of any of the terms below will result in termination of your Account. You agree to use the Service at your own risk and subject to the terms set forth below.
Account terms
• You must be 16 years of age or older to use this service.
• You must be a human being. Accounts registered by “bots” or other automated methods are not allowed.
• You are responsible for maintaining the security of your account and password. Empática cannot and will not be responsible for any loss or damage from your failure to comply with this security obligation.
• The Customer is responsible for all text, data, graphics, images, photos and video files published in the App (“Content”) and activity that occurs under his account (even if the content has been written by others who have access to his account).
• You are responsible for any images and comments you post to the App.
• You agree not to post any defamatory, racist, xenophobic, sexist, pornographic, discriminatory or violent content.
• You may not use the Service for any illegal or unauthorized purpose. You must not, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright and privacy laws).
Account Cancellation and Deleting
You are the only responsible for the cancellation of your account correctly. Account cancellation requests must be submitted in writing to the customer.
Empática, in its sole discretion, has the right to suspend or terminate your account and deny you present or future use of the Service, or any other Empática service, for any reason and at any time. Such termination of the Service will result in the deactivation or deletion of your account or your access to your account, and the deletion of all content in your Account.
Empática reserves the right to refuse to provide the service to any person for any reason and at any time.
Service Modifications
Empática reserves the right at any time to modify or interrupt, temporarily or permanently, the Service (or any part thereof) with or without notice.
From time to time, Empática may issue an update for the Service which may add, modify and/or delete functions. These updates may be carried out automatically with little or no notice.
Copyright and Ownership of Content
We do not claim intellectual property rights over its content. Your profile and materials published by you are your property. The general contents published in the App are the property of the Client.
Empática is the exclusive owner of all rights, titles and interests in and to the App, including all associated intellectual property rights. Notwithstanding the foregoing, you may not duplicate, copy or reuse any part of Empática, the Site or the Service without the express written permission of Empática.
Privacy
The contents of the App must comply with all applicable laws and privacy regulations.
Terms and Conditions
Use of the service is at your own risk.
You understand that Empática uses external providers and servers to provide the hardware, software, networks, storage and technology necessary to execute the service.
You must not modify, adapt or hack the service or modify another website in order to falsely imply that it is associated with the Service, or any other service Empática.
You agree not to reproduce, duplicate, copy, reverse engineer, sell, resell or exploit any part of the Service, use of the Service or access to the Service without the express written permission of Empática.
We may, but have no obligation to remove any Content and accounts that contain content that we deem, in our sole discretion, to be criminal, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or that violates the intellectual property of any party or these Terms of Service.
Any verbal, physical, written or other abuse (such as threats of abuse or punishment) of any customer to Empática members will result in immediate account termination.
Empática does not warrant that (i) the service will meet your specific needs, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of the products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
You expressly understand and agree that Empática shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Empática has been advised of the possibility of such damages), resulting from: (i) the use or inability to use the Service; (Ii) the cost of acquiring goods and services by reason of the goods, data, information or services purchased or substitutes obtained or messages received or transactions made through or from the Service; (Iii) unauthorized access to or alteration of your transmissions or data; (Iv) statements or conduct of third parties on the Service; (V) or any other matter related to the Service.
You agree to defend, indemnify and hold Empática, its employees and agents, harmless from and against any and all claims, liabilities, damages, losses and expenses, including without limitation reasonable attorneys’ fees and costs, arising out of or in any way with (i) your access to or use of the Site or the Service; (ii) your violation of these Terms of Service; or (iii) your violation of any third party rights, including without limitation any intellectual property rights, publicity, confidentiality, property or privacy rights by you or your application.
Empática’s failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitute the entire agreement between you and Empática and govern your use of the Service and supersedes any prior agreement between you and Empática (including, but not limited to, any prior version of the Terms of Service).
